O Projeto de Lei 658/22 estabelece nova hipótese de crime de responsabilidade para ministros do Supremo Tribunal Federal (STF): manifestar, por qualquer meio de comunicação, opinião sobre processo pendente de julgamento. E ainda manifestar juízo depreciativo sobre despachos, votos ou sentenças, de órgãos judiciais ou sobre as atividades dos outros Poderes da República, ressalvada a crítica nos autos e em obras técnicas ou no exercício do magistério.Autor da proposta, o deputado Paulo Eduardo Martins (PL-PR) destaca que a Lei Orgânica da Magistratura Nacional já veda aos magistrados manifestar, por qualquer meio de comunicação, opinião sobre processo pendente de julgamento, seu ou de outrem, ou juízo depreciativo sobre despachos, votos ou sentenças, de órgãos judiciais.
“Essa nova hipótese de crime de responsabilidade já estava prevista na Lei Orgânica da Magistratura Nacional como conduta vedada aos juízes e agora, diante da atuação recente do Supremo Tribunal Federal , faz-se necessária a alteração aqui proposta”, afirma. Segundo o parlamentar, o intuito do texto é “preservar a necessária imparcialidade do STF”.
Em análise na Câmara dos Deputados, o projeto altera a Lei 1.079/50, que define crimes de responsabilidade. Hoje a lei prevê como crimes de responsabilidades dos ministros do STF: alterar, por qualquer forma, exceto por via de recurso, a decisão ou voto já proferido em sessão do Tribunal; proferir julgamento, quando, por lei, seja suspeito na causa; exercer atividade político-partidária; ser patentemente desidioso no cumprimento dos deveres do cargo; e proceder de modo incompatível com a honra dignidade e decoro de suas funções.
Impeachment
O texto faz ainda outra mudança na Lei 1.079/50, proibindo o Senado Federal de realizar novo juízo de admissibilidade da acusação contra presidente da República após sua admissão pela Câmara dos Deputados. Nesse caso, o Senado deverá instaurar o processo.
“Inexiste competência do Senado para rejeitar a autorização expedida pela Câmara dos Deputados. Nem poderia. O comando constitucional é claro ao indicar que, admitida a acusação contra do Presidente da República, será ele submetido a julgamento”, avalia Paulo Eduardo Martins.
Tramitação
A proposta será analisada pela Comissão de Constituição e Justiça e de Cidadania; e pelo Plenário.
